Welcome to saverobberg.com. By accessing or using this site, you agree to these Terms of Use. If you do not agree to them, please do not use the site. We have kept these terms as plain as we can. They explain who we are, what this site does, what you can and cannot use it for, and the limits of our responsibility.
These Terms should be read together with our Privacy Notice, which explains how we handle personal information.
saverobberg.com is a citizen-run initiative administered by Daron Chatz. It exists to facilitate public awareness of, and participation in, environmental and planning decisions affecting the Robberg Coastal Corridor, the Cradle of Human Culture and the surrounding landscape.
We are not a registered company or non-profit organisation. We are not a law firm or a firm of environmental consultants. We are not affiliated with any political party, government body, conservation organisation, applicant, landowner, attorney or environmental practitioner. We are a group of concerned citizens who have built a website to help other concerned citizens participate in statutory public processes.
This site:
We do not provide legal, environmental, planning, financial or other professional advice. Information on this site is provided for general civic information only and is not a substitute for advice from a qualified professional.
We do not act as your representative or agent in any statutory process. Submissions you make through this site are your own submissions, made in your own name and on your own initiative.
We do not guarantee any particular outcome of any public participation process, application, decision, petition or campaign.
We have no role in the decisions of the authorities responsible for the applications we discuss, and any expression of opinion on this site is just that, an expression of opinion by concerned citizens.
The factual statements on this site are drawn from the public record, including application documentation, public gazettes, statutory plans and instruments, peer-reviewed scientific publications and published news reports. We aim for accuracy, but the site is run by volunteers and we do not warrant that all information is complete, current, or free from error.
If you believe any factual statement on the site is inaccurate, please contact us. We welcome correction on the merits, with reference to the public source you rely on for the alternative position.
We are not responsible for the content of any third-party site we link to. Links are provided for convenience and do not imply endorsement.
When the objection submission form was active, the form generated an email on your behalf, populated with information you provided and with the specific concerns you selected, and sent that email to the public participation recipients listed on the form at the time of submission. The site is the means by which the email was prepared and dispatched. The author of the submission, for all legal purposes, is you.
The same applies to petition signatures: when you sign the petition, you indicate your personal support in your own name.
By using any form on this site, you confirm that:
You undertake not to use the site to:
We reserve the right to decline or remove submissions that, in our reasonable view, do not comply with these undertakings.
The substantive views, concerns and statements expressed in any individual objection submitted through this site are the views of the signatory of that objection, not necessarily our views. We make available a templated structure to help signatories articulate their concerns, but the choice of which concerns to raise, and the specific text of the objection submitted, is the signatory's own.
The original content of this site, including text, layout, design and images we have created, belongs to us. You may share, quote or reproduce content from this site for non-commercial civic, educational or journalistic purposes provided you credit saverobberg.com.
Where the site uses or reproduces content from public sources (such as government documents, scientific publications or news reports), the original copyright belongs to the relevant source and any such use here is made under fair dealing for the purposes of comment, criticism, news reporting and discussion of matters of public interest.
To the maximum extent permitted by South African law:
This site and its content are provided on an "as is" basis. We make no warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for any particular purpose, or non-infringement.
We are not liable for any direct, indirect, incidental, special, consequential or punitive loss or damage arising out of or in connection with your use of, or inability to use, this site, including any reliance on information on this site.
We are not liable for the consequences of any submission you make through this site, including any decision (or absence of decision) by any authority on any application, any action taken or not taken in response to any submission, or any commentary by any third party in response to public participation in the matters this site discusses.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under South African law, including liability for fraud, intentional misconduct, or gross negligence resulting in death or personal injury.
We are independent. We do not receive funding or direction from any landowner, applicant, conservation organisation, government body, political party or commercial interest in respect of the matters this site discusses. The site is operated by volunteers using personal resources.
Where, in future, we receive any form of support, donation or contribution that could reasonably be considered to affect the independence of the site, we will disclose that openly on the site.
We may update these Terms from time to time to reflect changes to the site, our operations, or applicable law. The current version is dated at the top of this page. Continued use of the site after a revised version is posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms is subject to the non-exclusive jurisdiction of the courts of the Western Cape.
If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, the remaining provisions will continue in full force and effect.
